A case generally cannot be expunged if:
The sentence is incomplete (still on probation, still have classes to take, etc.)
The defendant has other open charges
The defendant owes fines, fees, or restitution
The defendant served more than a year in custody, but there are exceptions to this rule. The defendant may still be able to expunge if:
The charge was a minor theft or drug charge (see Proposition 47)
The charge was for certain marijuana offenses (see Proposition 64):
Possession (H&S 11357)
Cultivation (H&S 11358)
Possession for Sale (H&S 11359)
Transportation (H&S 11360)
Personal Use (H&S 11362.1)
The defendant attended Fire Camp (see AB 2147)
